This Privacy Policy applies to “you” our clients, prospects, business partners, candidates, anyone using our website (“users”), suppliers and any other third parties with whom we may work or to whom we supply our services, including recruitment process outsourcing (RPO), search, and talent consulting.

Our website does not automatically collect any individually identifiable information from visitors. Direct Collection: when you contact or interact with us, you choose to provide us your Personal Information, such as complete a form on the website, use our services or provide services to us, engage with us on social media, submit your resume, attend an event that we sponsor, interview or other interaction. Consent is always obtained to process and acquire your Personal Information.

Indirect Collection: we may obtain your Personal Information from publicly available resources and databases, including but not limited to social media websites, such as Facebook or LinkedIn, advertisements, public job boards, industry organizations, industry events, and contact databases, as it relates to your job title, education, and employment.

You can interact with us through social media websites, such as LinkedIn, Facebook, Instagram, or through sharing features on sourcing platforms used for matching job candidates with potential clients. If you elect to use these websites, we will be able to access basic Personal Information, including but not limited to your name, email address, pictures, geographic location, or activity posted on your accounts.

In addition to the information you provide, or accessed through social media websites, we may collect information from publicly or commercially available sources that we deem credible.

The information outlined above may be stored in Guardian’s internal systems, including but not limited to client relationship management (CRM), marketing automation software applications, applicant tracking system (ATS), talent acquisition software platforms, on secure cloud-based servers that are not accessible by third parties. These systems permit our employees to access and process such Personal Information solely for the purposes of client fulfillment, business reporting and administration, statistical analysis and marketing of Guardian’s services.

We do not sell our mailing lists to external organizations. We will not disclose your Personal Information to third parties, except with your consent or as required by law.

We may use your Personal Information for direct marketing of our services. If at any time you wish us to stop using your information for any purposes, please contact us as outlined in a section below. We will stop the use of your Personal Information for such purposes as soon as reasonably possible.​

We want to inform you that whenever you visit our website, we collect information that your browser sends to us that is called Log Data. When you provide your Personal Information to an individual at Guardian, such as a recruiter, you consent to provide that information to the entire company. Depending on your relationship to Guardian, we may share your Personal Information with various third parties who perform functions or services on our behalf, including but not limited to:

  • Agents who provide services to Guardian.

  • Service providers who perform functions on our behalf.

  • Vendors, consultants, and other third-party service providers to help us provide services.

  • Clients that we provide services for.

  • Public authorities who make a lawful request.

However, they are obligated not to disclose or use the information for any other purpose.

Security

Guardian values your trust in providing us with your Personal Information, thus we are striving to use commercially acceptable means of protecting it. We have implemented technology, security policies and measures to protect the Personal Information that we have under our control from unauthorized access, improper use, alteration, unlawful or accidental destruction and accidental loss. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

Guardian’s website may contain links to other websites. If you click on a third-party link, you will be redirected to that site. Children’s Privacy

Guardian does not knowingly collect Personal Information from individuals under the age of 18. In the case we discover that an individual under the age of 18 has provided us with Personal Information, we will immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us so that we will be able to take the necessary actions.

SMS Alerts

Your privacy is extremely important to us. We will only use the information you provide through the Guardian website or associated job sourcing platforms to transmit text messages and respond to you, if necessary. This includes but is not limited to, sharing information with platform providers, phone companies (carriers), and other vendors who may assist in the delivery of mobile messages.

This Privacy Policy (the “Policy”) governs how we treat the Personal Information that we collect and receive from you in connection with the use of text or SMS messaging. WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH THE GUARDIAN TO ANY THIRD PARTY.

Opting In

A mobile user might opt-in by entering a mobile telephone number online or sending a text message to Guardian.  When you opt-in to Guardian SMS messaging, Guardian will send an SMS message to confirm your signup.

 

We are able to deliver messages to the majority of US mobile phone carriers. The mobile carriers are not liable for delayed or undeliverable messages. Message and data rates may apply for any messages sent to You from Guardian and to Guardian from You. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Opting Out

When You opt-in to Guardian SMS messaging, Guardian will send an SMS message to confirm your signup. You can cancel the SMS service at any time. Just text "STOP" to the number that You received the message from. After You send the SMS message "STOP" to the number, Guardian will send You an SMS message to confirm that that the number has been unsubscribed. After this, You will no longer receive SMS messages from Guardian. If You want to join again, just sign up as you did the first time and Guardian will start sending SMS messages to you again. 

 

We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.

 

No Guarantee

Guardian does not guarantee that you will receive any employment or job offers through the Guardian Site and is neither your employer nor your agent based solely on your usage of the Guardian Site.

No Warranties and Limitation of Liability

Your use of the Website is at your sole risk. Guardian strives to ensure the accuracy of the information presented on the Website, however due to various circumstances, including, but not limited to, delays caused by internet service providers, upgrades and/or changes to Guardian's systems there may be variances between the information available on the Website and other data.

Indemnification

You agree to indemnify Guardian and all of its business units, content providers, agents and the like, in each instance from and against any and all claims, suits, liabilities, expenses (including, without limitation, attorneys’ fees), and/or damages arising out of claims based upon your use of the Website including, without limitation, any claim of libel, defamation, violation of legal rights of others (including rights of privacy or publicity), loss of service by other subscribers and/or infringement of intellectual property or other rights.

Prohibited Uses; Your Transmissions

In addition, You warrant that all so-called moral rights in the content have been waived. Moreover, Guardian does not make any representation with respect to, nor does it endorse the accuracy, completeness, timeliness, or reliability of any advice, opinion, statement, or other material displayed, uploaded, or distributed by You or any other user.
